Rebate Offers & Disclosures

Perch Apartment Locating LLC (“Perch,” “we,” “us,” or “our”) may, from time to time, offer rebates or gift cards (“Rebate”) as part of our apartment locating services. This page describes the conditions, limitations, and payout procedures for rebates, in compliance with Texas Real Estate Commission (TREC) requirements and applicable state and federal law.
1. Conditional Rebate — No Guarantee
- All rebate offers are contingent on the owner or management company of the apartment property agreeing to pay Perch a locator commission or placement fee.
- Some properties maintain a “no rebate” policy or refuse to permit third-party rebate allocation. In those cases, no rebate is available.
- The availability, amount, and payment of any rebate cannot be guaranteed and depend entirely on property policy, commission structure, and Perch’s internal rebate program.
2. Rebate Amount Determination
- The amount of any rebate will depend on the actual commission or fee paid by the property to Perch.
- Your agent (working under Perch) may provide you an estimate of the rebate, but that estimate is not binding until confirmed.
- The final rebate amount may vary from the estimate, based upon the property’s payment and any promotional or policy limitations.
3. Rebate Payout Procedure
- Once Perch receives full payment of the locator commission or placement fee from the property, your agent (under Perch) will issue your rebate within 30 days.
- The rebate will be sent under the agent’s direction (not by the brokerage directly), as a reimbursement or credit to you.
- If for any reason the property fails to pay, rejects commission, or reverses payment, no rebate will be issued.
- Rebate payouts are contingent upon successful lease commencement, move-in, and verification by Perch or the agent, as required.
4. Representation Requirement & Written Disclosure
- Under TREC Rule 535.147(d), a license holder may rebate part of a commission/fee only to a party that the license holder represents in the transaction.
- Accordingly, you must be represented by Perch (or a Perch agent) in the transaction for a rebate to be legally allowed.
- All parties in the transaction must receive written notice of rebate terms and amounts, either via your service agreement, claim form, or a written disclosure document.
5. Restrictions, Conditions & Deadlines
- Only one rebate per lease is eligible (unless otherwise agreed in writing).
- You may be required to list Perch Apartment Locating LLC (or your Perch agent) as the referral source on the property’s guest card, application, or lease paperwork.
- You must submit any required rebate claim or confirmation form within 30 days after lease commencement, unless otherwise specified.
- Rebates are non-transferable and payable only to the individual(s) on the lease agreement (or as otherwise agreed).
- Perch reserves the right to modify, suspend, or cancel any rebate promotion, provided prior rebate commitments in approved writing are honored (subject to verification).
6. Advertising Disclosures
- All promotions, advertisements, or websites that mention a rebate will include clear disclosure that rebates are subject to property policy, restrictions, and property consent.
- Such advertising will also disclose that rebate issuance is contingent upon the property paying the commission, and that the estimate may differ from the paid amount.
- These disclosures satisfy TREC Rule 535.155 (advertising restrictions and required disclaimers).
7. Tax Responsibility
- You are responsible for any tax or reporting obligations associated with receiving a rebate or gift card.
- Consult a tax advisor to determine whether you must report the rebate as income, depending on your jurisdiction and tax status.
8. No Guarantee of Results
- A rebate program does not guarantee your lease approval, access to a particular unit, or that Perch will be able to secure your preferred apartment.
- The existence of a rebate does not alter any terms, conditions, or obligations of any lease or apartment transaction.

10. Change Log / Right to Amend
- Perch reserves the right to change, modify, suspend, or terminate rebate programs or policies at any time, with or without notice.
- Any rebate claim approved in writing under prior terms will still be honored, provided the property pays the commission and all other conditions are met.
